Incinerator battle back in court next month

Both sides in a lawsuit regarding the incoming Durham-York incinerator will reappear in court next month, during which the first steps of an appeal by environmental group DurhamCLEAR will be set.
_The appeal is in regards to one aspect of a Dec. 15 court decision on the matter, specifically that the group must post $40,000 in security costs a week prior to final arguments of the group’s application to challenge the construction of the facility. The challenge against the Region of Durham is based on what DurhamCLEAR alleges would be a zoning violation should the facility be built in its current site in Clarington.
_While the group agreed with much of the recent decision, which essentially states that DurhamCLEAR does have a legal argument to challenge the Region, a recent statement declares that DurhamCLEAR ‘does not have $40,000 and it would be impossible to raise it within the time frame allowed.’
_Construction on the facility, which will burn waste from Durham and York, is slated to begin this month.
_In addition to environmental concerns, the incinerator has also been the subject of controversy regarding the cost and expenditure of funds for an August groundbreaking ceremony, which attracted a sizable protest near the facility’s future site.
